353.01 DEFINITIONS.
As used in this chapter:

(a) "Parking meter" means and includes any mechanical device or meter not inconsistent with this chapter placed or erected for the regulation of parking by authority of this chapter. Each parking meter installed shall indicate by proper legend the legal parking time established by the Municipality and when operated shall at all times indicate the balance of legal parking time, and, at the expiration of such period, shall indicate illegal or overtime parking.

(b) "Parking meter space" means any space within a parking meter zone, adjacent to a parking meter and which is duly designated for the parking of a single vehicle by a line painted or otherwise durably marked on the curb or on the surface of the street adjacent to or adjoining the parking meters.

(c) "Parking meter zone" means and includes any restricted street upon which parking meters are installed and in operation.

353.02 PARKING METER ZONES DESIGNATED.
The streets or portions of streets or areas designated as parking meter zones in conformity with Section 305.04(t) shall constitute the parking meter zones of the Municipality.

353.03 MARKING OF PARKING SPACES.
The Director of Public Safety is hereby directed and authorized to cause to be marked off individual parking spaces in the parking meter zone, such parking spaces to be designated by lines painted or durably marked on the curbing or surface of the street. At such space so marked off no person shall park any vehicle in such a way that such vehicle is not entirely within the limits of the space so designated.

353.04 INSTALLATION OF METERS.
In the parking meter zone, the Director of Public Safety shall cause parking meters to be installed upon the curb or sidewalk immediately adjacent to the parking meters spaces, and the Chief of Police shall be responsible for the regulation, control, operation, maintenance and use of such parking meters. Each parking meter shall be so set as to display a signal showing legal parking upon the deposit of the appropriate coin or coins, lawful money of the United States of America, for the period of time prescribed by this chapter. Each parking meter shall be so arranged that upon the expiration of the lawful time limit it will indicate by a proper visible signal that the lawful parking period has expired and in such cases the right of such vehicle to occupy such space shall cease and the operator, owner, possessor or manager thereof shall be subject to the penalties provided in Section 353.99.

353.05 DEPOSIT OF COINS.

(a) When any vehicle is parked in any parking meter space, the operator of such vehicle shall, upon entering the parking meter space, immediately deposit or cause to be deposited in the meter such proper coin of the United States as may be required for such parking meter and as designed by proper directions on the meter. Failure to deposit such proper coin or coins shall constitute a violation of this chapter. Upon the deposit of such coin, the parking space may be lawfully occupied by such vehicle during the maximum period of time which has been prescribed for the particular meter space, provided that any person placing a vehicle in a parking meter space adjacent to a meter which indicates that unused time has been left in the meter by the previous occupant of the space, shall not be required to deposit a coin so long as his occupancy of the space does not exceed the indicated unused parking time. If such vehicle remains parked in any such parking meter space beyond the maximum parking time limit set for such parking meter space as is designated by proper directions on the meter, and if the meter indicates illegal or overtime parking, then, and in either of such events, such vehicle shall be considered as parking overtime and beyond the period of legal parking time, and such parking shall be deemed a violation of this chapter.

(b) In case of emergency determined by an officer of the Division of Fire or the Division of Police, the privilege of parking in any parking meter space may be withdrawn and the operator of any vehicle shall comply with the orders and directions of such officer of the Division of Fire or member of the Division of Police or shall comply with any traffic control sign or signal placed on the street or curb indicating that parking is temporarily prohibited. Parking in such a prohibited area shall be deemed a violation of this chapter.

353.06 HOURS OF METER ZONE PARKING.

(a) In the parking meter zone, all parking shall be prohibited between 9:00 a.m. and 5:00 p.m. on Monday through Saturday, inclusive, of each week, unless the owner or operator of a vehicle parked in a parking meter space shall, upon entering the space, deposit coins in the parking meter as herein provided.

(b) The provisions herein for the use of parking meters shall not apply to parking on Sunday or on those holidays designated by the Director of Public Safety. During the times when the parking meters are not in operation under the provisions of this chapter, vehicles may be parked in parking meter spaces without the deposit of any coins in the parking meters.

353.07 RULES AND REGULATIONS.
No person shall:

(a) Cause, allow, permit or suffer any vehicle registered in the name of such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described, or deposit in any parking meter any coin for the purpose of parking beyond the maximum legal parking time for the particular parking meter space occupied by such vehicle.

(b) Cause, allow, permit or suffer any vehicle operated by such person to be parked overtime, or beyond the period of legal parking time established for any parking meter zone as herein described, or deposit in any parking meter any coin for the purpose of parking beyond the maximum legal parking time for the particular parking meter space occupied by such vehicle.

(c) Permit any vehicle, registered in the name of or operated by such person, to remain in any parking space adjacent to any parking meter while such meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period prescribed for such parking space.

(d) Cause, allow, permit or suffer any vehicle registered in the name of such person, or operated by such person, to be parked across any line or marking of a parking meter space or in such position that the vehicle is not entirely within the area designated by such lines or markings.

353.08 PURPOSE OF FUNDS.
The coins deposited in parking meters are required and shall be used for the purchase, operation and maintenance of the parking meters, for the proper regulation of traffic on public streets, for providing street markings, traffic signs and control devices, for maintaining the same and for similar purposes. Such money shall be paid into a special fund known as the Parking Meter Fund.

353.09 STOPS FOR COMMERCIAL VEHICLES.
Nothing in this chapter shall be construed as prohibiting the Municipality from providing for bus stops, for taxicab stands and other matters of similar nature, including the loading or unloading of trucks, vans or other commercial vehicles.

353.10 SELLING MERCHANDISE FROM VEHICLE PARKED IN METERED ZONE.

(a) No person who sells or offers for sale merchandise from any vehicle within the metered section of the City for the purpose of selling his wares therefrom.

(b) This section shall apply to all persons, firms, associations or corporations notwithstanding the fact that such persons, firms, associations or corporations have procured a license from the City and have conformed to Chapter 745, or are authorized to sell merchandise from their vehicles under State law.

(c) This section does not apply to persons, firms, associations or corporations who are loading or unloading merchandise from their vehicles to serve the stores throughout the metered section of the City.

353.11 PARKING CERTIFICATES.

(a) The Director of Public Safety is hereby authorized and directed to issue free parking certificates to families who are residents of the following designated metered zones within the City:

(1) Union Street, west side only from 33rd Street to 34th Street;

(2) Guernsey Street, from 31st Street to 34th Street, both sides;

(3) 33rd Street, from Union Street to Guernsey Street;

(4) 34th Street, from Union Street to Plum Alley;

(5) Belmont Street, from Crescent Street (30th Street) to 31st Street, both sides.

(b) Upon application by a member of such a family to the Director, and the payment of a prescribed fee, the Director shall issue to one member of each family a free parking certificate which shall entitle such person to park their automobile within the zone in which such family resides, as designated in subsection (a) hereof. The Director shall issue a free parking permit on a monthly basis for two dollars ($2.00).

(c) Each application shall contain the name of the person applying, his place of residence, the make or model of car, the license number, the names of members of his family or household and other information which may be required by the Director.

353.99 PENALTY.

(a) Whoever violates any of the provisions of this chapter in regard to overtime parking within the metered zone of the City, shall be charged one dollar ($1.00) for any such violation if paid within seventy-two hours of the time of the violation, and two dollars ($2.00) if paid within thirty days of the violation.

(b) No person shall fail to pay the fines prescribed herein, and any failure to pay such fines within thirty days from date of the violation shall constitute a minor misdemeanor for which violation the offender shall be subject to arrest and penalty in accordance with Section 303.99.

(c) Any subsequent violations of Chapter 353 shall be treated as separate violations for which the violator may be ticketed, or arrested in the event of non-payment of the prescribed fine within thirty days of the violation.
